LEGAL

Terms of service

DRAFT Not yet reviewed by a lawyer. Don't rely on this wording until it has been. Items marked PLACEHOLDER need real details.

Last updated PLACEHOLDER: date. These terms cover buying and using kimsim travel eSIMs.

1. Who we are

kimsim is operated by PLACEHOLDER: company legal name, registered address and company number. Contact: PLACEHOLDER: support email.

2. What you're buying

A prepaid, data-only eSIM plan for the destination and allowance shown at checkout. Plans don't include a phone number, calls or SMS. Network service is provided by local partner networks through our supplier; the networks shown on each destination page are the ones our supplier lists for that plan, and coverage and speed depend on the local network.

Plan validity starts when the eSIM first connects to a supported network at the destination, unless the plan says otherwise. An eSIM must be installed within the install window shown (up to 180 days from purchase).

“Unlimited” plans give a daily full-speed allowance, then continue at 1 Mbps until the daily reset. “Day Pass” plans work the same way at the slower speed shown on the plan.

3. Your phone

You're responsible for checking that your phone supports eSIM and is carrier-unlocked before you buy. See Will my phone work? Each eSIM can be installed once and can't be moved to another phone.

4. Prices and payment

Prices are in US dollars and include PLACEHOLDER: tax treatment, e.g. any VAT/GST. Payment is taken in full at checkout by our payment processor, Stripe. We don't see or store your full card details.

5. Refunds

You can request a full refund for an eSIM that hasn't been installed, from My eSIMs → Order history. Installed eSIMs and eSIMs that have used data can't be refunded, except where we failed to deliver the service or where the law gives you a right to a refund. Top-ups can't be refunded once applied. See Refunds. PLACEHOLDER: check consumer-law cancellation rights (e.g. UK/EU 14-day rule for digital content) with a lawyer

6. Fair and lawful use

Don't use kimsim for anything illegal, for reselling, or in a way that harms the network (for example, as a fixed home broadband line or for automated traffic). We may suspend an eSIM that's being misused, after telling you where we reasonably can.

7. Your account

We create an account from your checkout email so you can see and top up your eSIMs. You can sign in with an email link or code, or with Apple or Google. Keep access to your email account secure.

8. Liability

We're not responsible for local network outages, coverage gaps or speeds outside our control, or for charges from your home carrier. Our total liability for any order is limited to the amount you paid for it, except where the law doesn't allow that limit. PLACEHOLDER: lawyer to review

9. Changes and governing law

We may update these terms; the version in force when you bought applies to that order. These terms are governed by the laws of PLACEHOLDER: jurisdiction.
